Draft: this text will be reviewed before SideJobWorks launches publicly.
1. Who can use SideJobWorks
You must be at least 18 years old and able to enter a binding contract. One person may have one account. Information on your account and profile must be true and your own.
Accounts that were closed for breaking these terms may not be re-created, including with a different email address.
2. What SideJobWorks is, and isn't
SideJobWorks is a venue that connects clients and freelancers and records their projects. We are not a party to the agreement between a client and a freelancer, we are not an employer or agent of either, and we don't guarantee the quality, safety or legality of any job, work or payment.
While payments are made directly between users, SideJobWorks does not receive, hold, refund or release project money. Any refund has to be agreed between the users.
3. Jobs, proposals and contracts
Job posts must describe real work that you intend to pay for. Proposals must be written for the job they are sent to.
A contract starts when the freelancer accepts the client's offer and payment plan in the Project Tracker. Changes to price, deadline or scope must be agreed on SideJobWorks by both sides.
Free accounts have limits (for example on open jobs and monthly proposals) to prevent spam. We may change these limits.
4. Staged payments and the Project Tracker
The client pays each stage directly to the freelancer and marks it as paid; the freelancer confirms receipt. If a stage marked as paid isn't confirmed or disputed within 3 days, it is recorded as paid. If a requested stage isn't approved or sent back within 7 days, it is recorded as approved. Approved stages unpaid after 7 days are recorded as paid late on the client's profile.
Don't hand over final work before the last stage is paid, and don't pay for work you haven't seen.
5. Evidence: keep it on SideJobWorks
Only messages, files, confirmations and activity recorded on SideJobWorks are considered when we look at a dispute. Agreements made on WhatsApp, email or other apps are not considered.
Messages can't be permanently deleted by users; they are kept as a record of the project.
6. Disputes
Either side can open an issue from the Project Tracker. The other side has 3 days to respond and 7 days to resolve it.
If the other side doesn't respond in time, the system decides in favour of the person who opened the issue. Cases where both sides disagree, or that concern quality or scope, are decided by our team based on the recorded evidence. Each decision can be appealed once within 7 days.
Our decisions affect records on SideJobWorks only (stage status, profile labels and strikes). They are not a court judgment and don't stop you from using other legal remedies.
7. Strikes and account sanctions
A strike is given when a dispute is decided against you or when our team finds a serious rule violation, including a false report.
1 strike: a "Reported" label on your profile for 90 days. 2 strikes: you can't post jobs or send proposals for 30 days. 3 strikes: your account is closed permanently and your email can't be used again.
Strikes expire after 12 months without a new violation (except after a permanent ban). You can appeal each strike once.
We may suspend an account straight away while we review a safety report.
8. Things you must not do
Scams, fake jobs, asking anyone for a fee to apply or get hired, or asking for passwords or banking credentials.
Harassment, hate, threats, sexual content, or anything illegal where you or the other user live.
Moving a conversation off the platform to avoid our rules, sharing contact details to bypass a contract, or creating fake reviews.
Jobs that involve unsupervised care of children or the elderly, require the worker to stay overnight, or ask to meet somewhere unrelated to the work.
Uploading files you don't have the right to share, malware, or anything that infringes someone else's rights.
9. Your content
You keep ownership of what you post. You give SideJobWorks a non-exclusive, worldwide, royalty-free licence to host, display and process it to run the service, including showing your public profile and job posts in search engines.
Ownership of work created under a contract is agreed between the client and the freelancer. Unless they agree otherwise, rights in the final work pass to the client once every stage is paid.
10. Reviews
Reviews must be honest and about a real project. They appear after both sides review, or after 14 days, and can't be edited once published. Report a review you believe breaks these terms.
11. Ads and paid features
SideJobWorks shows ads. We may introduce optional paid features. We'll tell you before charging for anything, and nothing you're already using will start costing money without notice.
12. Liability
SideJobWorks is provided "as is". To the extent allowed by law, we are not liable for losses arising from agreements or payments between users, from content posted by users, or from the site being unavailable.
Where liability can't be excluded, it is limited to the amount you paid SideJobWorks in the 12 months before the claim (currently zero, as the service is free).
13. Ending your account
You can stop using SideJobWorks at any time and ask us to close your account. Records of projects you took part in are kept so the other side still has them. We may close accounts that break these terms.
14. Changes and law
We may update these terms. If a change is significant we'll tell you on the site or by email before it takes effect.
These terms are governed by the laws of the Republic of Indonesia, without limiting any consumer protections you have where you live.
